Terms of Use

These Terms govern the use of the Plavni platform (the plavni.com website and the mobile apps, hereinafter the “Service”), operated by a private individual in Ukraine (“we”, “Plavni”). Beta versions of the apps (in particular via TestFlight) may be unstable — we do not guarantee that data created in beta builds will be preserved. The Service is currently free of charge; should paid features appear, we will announce their terms separately and in advance. By using the Service you accept these Terms and the Privacy Policy. If you do not agree, please do not use the Service.

The Service may be used by persons aged 16 and over. By registering you confirm that you are at least 16 years old and that the details you have provided are true.

We welcome anglers from all over the world. At the same time, the Service is not provided to persons located in the territory of the russian federation (the aggressor state) or the republic of belarus, or who are residents thereof. By registering you confirm that you are not such a person. We may restrict access from these territories by technical means (including by geolocation) and block the accounts concerned without prior notice. If paid features appear in the Service, they will not be provided to such persons, and payments from them will not be accepted.

• You are responsible for keeping your account secure and for everything that happens in it.
• Do not share your credentials with anyone and notify us of any unauthorised access.
• One account — one person; do not impersonate others.

Reviews, catch logs, points, photos and comments are created by you (“User Content”). It remains yours. By posting Content you grant us a non-exclusive, royalty-free, worldwide licence to store, display and technically process it as part of running the Service (and in accordance with the audience you have chosen — everyone, followers, close friends or only yourself — and with the place visibility you have chosen). The licence lasts for as long as the Content is posted in the Service: if you delete the Content or your account, we stop displaying it (backups are purged within roughly 30 days). After the account is deleted, reviews and catches are anonymised and may remain in the Service without being linked to you — see the Privacy Policy for details.

By suggesting a water body or changes to the catalogue data (name, fish species, services and so on), you agree that, once moderated, this information becomes part of the Service’s open catalogue and may be edited by us without being linked to your account.

You warrant that:

• you hold the rights to the Content (photos in particular) and do not infringe anyone else’s rights;
• reviews and water-body data are based on your real experience and are not fake;
• the Content is not unlawful, offensive, misleading or harmful.

The following is prohibited, in particular:

• spam, artificial boosting, fake reviews or ratings;
• buy-and-sell listings in the feed, reports and comments (gear, boats, guided trips and so on) — a separate section will be added for trading;
• insults, harassment, hate speech, unlawful content;
• adding points, water bodies or any other content relating to the territory of the russian federation or the republic of belarus, as well as circumventing the access restrictions for these territories (see section 2);
• automated data collection (scraping), circumventing protections, attempts to harm the Service;
• using the Service in breach of the laws of Ukraine.

We may review, restrict or remove Content that breaches these Terms, and suspend or block the accounts of offenders. Where possible we explain the reason, but we may act immediately if there is a risk of harm to others or to the Service.

The name, logo, design, code and databases of the Service belong to us or to our licensors and are protected by law. These Terms do not transfer any rights in them to you, other than the right to use the Service for its intended purpose.

The Service uses third-party sources (in particular map data from OpenStreetMap and other providers) and may contain links to third-party resources for which we are not responsible. Information about water bodies, prices, services and catches is supplied by users and external sources and may be inaccurate or out of date — check important details (prices, rules, access) on site.

The Service is provided “as is” and “as available”, without warranties of uninterrupted operation, freedom from errors or fitness for a particular purpose. You use the Service at your own risk and are responsible for your own safety while fishing and while at water bodies.

To the extent permitted by law, we are not liable for indirect or incidental damages, loss of data or profit arising from the use of, or inability to use, the Service, nor for the Content of other users.

You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or terminate access in the event of a breach of these Terms or of legal requirements.

These Terms are governed by the laws of Ukraine. Disputes are settled through negotiation and, failing agreement, by the courts under the laws of Ukraine. This does not deprive consumers in the EU of the mandatory protection afforded to them in their country of residence.

We may update these Terms. We will announce material changes in the Service or by email; continued use means that you accept the changes.
